Who we are

WNDW is operated by WNDW Software Pty Ltd (ABN 74 698 755 627), based in Queensland, Australia. WNDW is a project tracking and documentation platform built for commercial subcontractors.

Agreement to terms

By accessing or using WNDW, you agree to be bound by these terms. If you do not agree, do not use the service. If you are using WNDW on behalf of a company or organisation, you confirm that you have authority to bind that entity to these terms.

The service

WNDW provides ITP (inspection and test plan) tracking, stage-based progress tracking, photo documentation, timesheeting, variation management, claims tracking, and project dashboards for commercial construction subcontractors. The service is delivered as a web-based application accessible at app.wndw.com.au.

Accounts

You must create an account to use WNDW. When you do:

One account per person. Do not share login credentials.
You are responsible for all activity under your account.
You must be at least 18 years old to use WNDW.
Keep your account details accurate and up to date.

We may suspend or terminate accounts that violate these terms or that have been inactive for an extended period, with reasonable notice.

Pricing and billing

WNDW is priced per active project, per month. Pricing details are provided during onboarding and confirmed in your service agreement. Here is how billing works:

Billing cycle: Billing runs on the 1st of each month for all projects that were active during the previous month.
No upfront charge: There is no charge when a project is activated. The first charge occurs on the 1st of the following month.
Active project: A project is considered active while stages are being marked off. Once all stages are complete, the project becomes inactive and is no longer billed.
7-day grace period: If a project becomes inactive within the first 7 days of a calendar month, it will not be billed for that month.
Payment method: Payment is collected via card on file.
No hidden fees: There are no setup fees, no per-user charges, and no lock-in contracts.

We may change pricing with at least 90 days written notice.

Free trial and account activation

When you sign up for WNDW, you have 14 days to create and activate your first project. During this period you may explore the platform and its features at no charge.

If no project is activated within 14 days of account creation, we reserve the right to suspend your account and restrict access to all platform features, including timesheets, reporting, and dashboards. Suspended accounts can be reactivated at any time by contacting us and setting up an active project.

Platform features such as timesheets, variation tracking, photo documentation, and reporting are provided as part of your active project subscription. Access to these features requires at least one active or previously billed project.

Data ownership

Your data is yours. All content you create in WNDW, including photos, ITPs, project records, timesheets, and variation documentation, remains your property. We do not claim ownership of your data.

You may request a full export of your data at any time by contacting us at [email protected]. Exports are provided in standard formats including PDF, CSV, and ZIP archives containing photos and attachments.

We retain your project data, including claims history, ITP records, and photos, for a minimum of 7 years after a project becomes inactive, to support compliance and record-keeping obligations common in the construction industry.

Acceptable use

When using WNDW, you agree not to:

Use the service for any unlawful purpose.
Attempt to gain unauthorised access to any part of the service or its infrastructure.
Reverse-engineer, decompile, or disassemble any part of the software.
Interfere with or disrupt the service or its servers.
Use the service to store or transmit malicious code.
Resell or redistribute the service without our written consent.

Availability and support

We aim to keep WNDW available and reliable, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We do not currently offer a formal service level agreement (SLA). Support is provided via email on a best-efforts basis.

Limitation of liability

To the maximum extent permitted by law, WNDW Software Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of WNDW. This includes, without limitation, loss of profits, data, or business opportunities.

Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months prior to the event giving rise to the claim.

Termination

Either party may terminate this agreement at any time for any reason. You can stop using the service and close your account by contacting us.

After termination, your data will remain available for export in accordance with the retention periods described in the Data ownership section above.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
